About Our Firm

The San Diego DUI Hotline is owned and operated by Butters and Bye, a law firm dedicated to DUI defense. We spend 100% of our time defending those accused of DUI. All of our partners are members of the National Association of Criminal Defense Lawyers and annually attend the DUI Defense three day “DWI means Defend With Ingenuity Seminar” in partnership with the National College of DUI Defense. Understanding and knowing how to apply all of the available DUI defense techniques is essential in our effort to provide our clients with an excellent legal defense.

After the first phone call, in most cases you will come to our offices for our first face to face meeting. During this initial consultation, we spend at least an hour, and sometimes up to two, talking with you about your case and answering your questions. It is important that we go over every single detail of what happened on the day or night you were arrested. While it may seem tedious, a good defense attorney understands that the smallest fact may lead to an acquittal. We take the time to fully evaluate your situation and to provide you with an overview of what to expect and what consequences could happen. We also discuss what the best possible outcome would be for you and your case.

After your initial consultation, if you choose to retain our firm, we immediately begin working on your case. We notify the court and enter an appearance of counsel. In most cases, we enter your plea and request a jury trial. If you have called us within 10 days of your arrest, we contact the DMV and schedule a hearing to contest the automatic suspension of your driving license. We notify the District Attorneys Office and prepare an official request for discovery for all evidence in your case, including police reports, witness statements, pictures, recordings and any other evidence in possession of the prosecuting attorney.

While 95% of criminal cases are resolved prior to an actual jury trial, we believe in preparing for the 5% of cases that go all the way, all the time. First and foremost, we are trial attorneys with exceptional courtroom charisma and confidence who understand that courtroom excellence is a result of extensive previous preparation. We take great pride in our preparation and spend hours researching relevant case law, reviewing all evidence, interviewing witnesses, and drafting legal motions in anticipation of a pending jury trial. We do everything in our power to ensure our client his or her best possible outcome. If that best possible outcome presents itself before the jury trial begins, then our job is finished—and our client is happy.
